G.O.(Rt) No.1145/2005/LBR.                                                      Dated Thiruvananthapuram, 2 nd May, 2005.

S.R.O. No.429/2005:- In exercise of the powers conferred by sub-section (1) of section 85 of the Factories Act, 1948 (Central Act 63 of 1948) and in supersession of Notification issued under G.O.(Rt)No.2674/93/LBR & REH dated 18 th October, 1993, published as S.R.O.No.1679/93 in the Kerala Gazette Extraordinary No.1087 dated 28 th October, 1993, as amended by Notification G.O.(Rt)No.49/96/LBR dated 5 th January, 1996, published as S.R.O.No.78/96 in the Kerala Gazette Extraordinary No.94 dated 19 th January 1996, the Government of Kerala hereby declare that the provisions of the said Act specified in column (4) of the Schedule below shall apply to any place in the State of Kerala wherein any manufacturing process specified in column (2) of the said Schedule and described in column (3) there of is carried on, notwithstanding that

  • the number of persons employed therein is less than ten, if working with the aid of power and less than twenty if working without the aid of power; or
  • the persons working therein are not employed by the owner thereof but are working with the permission of, or under agreement with such owner;

Provided that the manufacturing process is not being carried on by the owner only with the aid of his family

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport)

Under the provision of section 85 of the Factories Act, 1948, the State Government is empowered to notify any place/premises and bring it under the purview of the Factories Act, if any manufacturing process is carried on in such places/premises. Accordingly Government have notified 60 manufacturing process under section 85 of the Factories Act vide notification No.G.O.(Rt)No.2674/93/LBR & REH dated 18 th October 1993, published as S.R.O.No.1679/93 in the Kerala Gazette Extraordinary No.1087 dated 28 th October, 1993, and subsequent Notification G.O.(Rt)No.49/96/LBR dated 5 th January, 1996, published as S.R.O.No.78/96 in the Kerala Gazette Extraordinary No.94 dated 19 th January 1996.

Government proposes to entrust the inspection work of hazardous manufacturing processes notified under section 85 (1) of the Factories Act to technically qualified Inspectors and the non-hazardous manufacturing processes coming under the purview of the Factories Act alone by the Additional Inspectors of Factories. In order to enable the Inspectors to exercise their statutory jurisdictions, the existing notifications are to be revised.

This notification is intended to achieve the above object.
